General Terms and Conditions
The following General Terms and Conditions (GTC) contain legal information on your rights in accordance with the regulations concerning distance contracts, and with those concerning e-commerce.
1.1 These General Terms and Conditions apply to all services and deliveries of the company SOLAR-RIPP ®/Ingenieurbüro, owned by Andreas Appel, Hauptstrasse 190, DE-53489 Sinzig, Germany, procured via the local internet shop. Deviating conditions of the buyer are hereby expressly excluded. Such conditions will not become part of the contract, either by delivery of the goods or by any other implied action.
1.2 A "consumer" within the meaning of these General Terms and Conditions is a natural person who concludes a legal transaction for purposes which are neither predominantly commercial, nor predominantly attributable to their independent professional activity. An "entrepreneur" within the meaning of these General Terms and Conditions is any natural or legal person or a legal partnership which, in concluding a legal transaction, exercises their independent professional or commercial activity.
2. Contracting party
A purchase contract is concluded with Andreas Appel, Hauptstrasse 190, 53489 Sinzig, Germany.
3. Expiry of the order
You order in our shop by
- adding items to your shopping cart
- proceeding to checkout
- logging in with your customer details or entering your shipping and billing address and a setting up a customer account
- selecting the shipping and payment method
- checking the data you have entered
- acknowledging our terms and conditions and cancellation policy, and confirming this
- confirming the accuracy of the information you have entered, by finally clicking on "Order, with obligation to pay".
4. Offer and conclusion of contract
4.1 Your order constitutes a binding offer to conclude a purchase contract with us. In ordering, you confirm that you wish to acquire the ordered goods.
4.2 You will receive a copy of the order data with the order confirmation email, which you can save. This confirmation does not constitute acceptance of your offer.
4.3 A purchase contract is only concluded if we accept your binding order by delivering the goods, or if we confirm acceptance in text form by means of separate transportation information/shipping notice sent by email. Acceptance of your order takes place at the latest within five working days.
4.4 Notwithstanding the above, in the event that an order is made with payment in advance, a purchase contract is concluded upon sending the request for payment by email. The request for payment shall be sent no later five working days after your order.
4.5 Contract conclusion is exclusively in English
5. Correction of input errors/storage of the contract text
5.1 You may at any time correct the contractual statement made by you in the framework of the order before submitting the form, by clicking on the "Back" button or by clicking on the respective "Edit" buttons. After sending the order, correction may no longer be made.
5.2 Your orders will be stored until the complete settlement of the purchase transaction. If you lose your documents pertaining to your orders, please contact us by email. We will send you a copy of your order, as long as your order has not been processed. After the complete delivery of the ordered goods, we will delete the order data, subject to the statutory retention periods. The data will no longer be available after this point.
6. Prices and shipping costs
6.1 The prices stated on the product pages are inclusive of statutory value-added tax, but exclude shipping costs.
6.2 The prices given on those pages accessible only to commercial resellers (companies) are exclusive of statutory VAT and shipping costs.
6.3 In addition to the prices, we charge for the costs of shipment. The shipping costs will be clearly indicated in the shipping costs overview, in the shopping basket and on the order page.
7.1 Delivery is made to all countries throughout the world. There are no shipping restrictions.
7.2 The delivery time is a maximum of 14 working days, provided that it is marked that we have the ordered product in stock. Any divergent delivery times will be indicated explicitly on the product page. The period for delivery begins on the day after the payment order is placed with the originator credit institution, and ends on the 14th working day after this. If the final day of the period falls on a Saturday, Sunday or a state-recognised public holiday at the place of delivery, then the next working day shall apply instead.
7.3 If the customer is an entrepreneur within the meaning of these terms and conditions, the risk of accidental loss of the goods is transferred to the customer upon delivery to the carrier performing the transportation.
8.1 Payment shall be made, at the discretion of the buyer, in advance, by credit card, by instant bank transfer via Giropay, by Apple Pay or via PayPal.
8.2 In the case of payment in advance, you will receive the payment details in a separate notification. Payment must be received by us within 14 days of receipt of this notification. We deliver the goods taking into account the stated delivery time after receipt of payment.
When you elect to pay by PayPal, instant bank transfer, credit card, Giropay or Apple Pay, please follow the payment instructions after completion of the order. PayPal is the online payment service with which you can pay for your purchases easily and quickly. Learn more about opening an account at PayPal at: https://www.paypal.de. For payments by credit card, bank transfer, Giropay and Apple Pay, we use our payment service provider, STRIPE (Stripe Inc., 185 Berry Street, Suite 550 San Francisco, CA 94107, USA. https://stripe.com/de/privacy). Your credit card and your account will be debited immediately after completion of payment made using these methods.
As soon as the payment is posted, we will deliver the goods, taking into account the stated delivery times.
9. Retention of title
The goods remain our property until full payment.
10.1 The period of limitation for statutory claims for defects is two years, and begins on the date of delivery, i.e. upon receipt of the goods by the buyer.
If the customer is an entrepreneur within the meaning of these terms and conditions, the warranty period is one year from delivery of the goods.
This shall be without prejudice to any claims due to damage resulting from injury to life, limb or health which are based on an intentional or negligent breach of duty by the seller or its legal representatives or vicarious agents, as well as claims due to other damage caused by an intentional or grossly negligent breach of duty on the part of the seller, its legal representatives or vicarious agents.
10.2 The statutory provisions concerning liability for defects otherwise applies to all goods offered by us.
11. Final provisions
11.1 The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN CISG, unless the protection afforded by mandatory provisions of the law of the state in which the customer (who is a consumer) has his habitual residence is withdrawn.
11.2 In the case of contracts with merchants – i.e. customers who operate a commercial enterprise, or who are classified as a merchant on other legal grounds pursuant to the German Commercial Code –, as well as with legal persons under public law, Sinzig (Koblenz, Germany) is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
11.3 Online dispute settlement is in accordance with Section 14(1) of the ODR regulation: The European Commission provides a platform for online dispute resolution (ODR), which you can find under https://ec.europa.eu/consumers/odr/.
